Micron was sentenced to patent infringement in China: Mass storage chips were banned

At the beginning of this year, Fujian Jinhua Integrated Circuit Co., Ltd. filed a lawsuit against US chip giant Micron, referring to some of its SSD solid-state hard drives. The memory products infringe patent rights and require the court to ban. A few days ago, the Fuzhou court ruled that Jinhua won the case.

Jinhua is an advanced integrated circuit manufacturer jointly established by Fujian Electronic Information Group and Jinjiang Energy Investment Group Co., Ltd., and has cooperated with Taiwan UMC to invest US$ 5.65 billion in Jinjiang City, Fujian Province. 300mm memory fab production line, developing advanced memory technology and process technology, and manufacturing and sales of related products.

Jinhua IC has been included in China's '13th Five-Year' integrated circuit major productivity layout plan, aiming to become a DRAM memory enterprise with advanced technology and independent intellectual property system.

Jinhua believes that Micron manufactures, manufactures, processes, imports, uses, sells, promises to sell the Yingruida MX300 525GB 2.5-inch solid-state hard drive, DDR4-2133 8GB notebook memory stick and other products without legal and effective authorization, allegedly infringing Jinhua patents right.

On January 19 this year, Jinhua filed a lawsuit against Micron for the related infringing products, and filed a complaint with the Fuzhou Intermediate People's Court, requesting that Meiguang immediately stop infringing the Jinhua patent, including but not limited to stop processing, use, import. , sales, promised to sell any infringing products infringing the patents of Jinhua Company, immediately destroy all infringing products and processing of inventories, use all relevant equipments and other equipments of infringing products, and request compensation amount of RMB 196 million.

On July 3, the Fuzhou Intermediate People's Court ruled that Micron Semiconductor Sales (Shanghai) Co., Ltd. immediately stopped selling, imported more than ten Yingruida SSDs, memory modules and related chips, and deleted the promotion of the above products on its website. Advertising, purchase links and other information.

At the same time, the court ruled that Micron Semiconductor (Xi'an) Co., Ltd. immediately stopped manufacturing, selling, and importing several memory products. According to Jinhua, Micron infringed products include MX500 2TB, 1TB, 500GB, 250GB 2.5-inch SSD. And related chips.

According to foreign media, there are a total of 26 products that Micron has been banned. Jinhua emphasizes that Jinhua’s patents were authorized in 2009 and announced to the outside world in 2012, and Micron is a well-known integrated circuit company in the world. With a top-notch professional patented technical team, it is impossible to understand the scope of the public protection of Jinhua Patent, but to use the patent in the unknown without legal authorization. Micron knows the previously sold MX 300 solid state drive. There is suspicion of infringement, and it continues to use the technical scheme of infringement of Jinhua patent on the currently popular mainstream product MX 500 series solid state hard disk. Micron has caused irreparable harm to Jinhua: Micron disclosed in its 2017 annual report that its China The sales of the district amounted to USD 10.4 billion, accounting for more than 50% of its total revenue. Due to the extensive and long-term use of the infringing products in this case, Jinhua cannot prohibit the continued use of the sold infringing products in thousands of households. Has caused continuous and huge damage and even injury.

Jinhua said that in the future, it will continue to pay attention to and collect any other infringing products that may be suspected of infringing on Jinhua's patent rights, including any memory chips and solid-state hard disks that are produced, processed, imported, used, sold, and promised to be sold using Micron's infringing chips. As a new entrant of the memory industry, only by attaching great importance to the protection of intellectual property rights can we avoid being killed by those who are unable to do so. We will actively adopt various rights protection measures to defend our rights and interests and will not tolerate any suspected infringement of the patent rights of Jinhua. .

It has been reported that this is the first time that China's development of semiconductors has been accused of 'stealing' and 'infringement', but this semiconductor game will last for a long time.
